Acceptance of Policies

These Policies and Terms of Use (also referred to as “Terms of Service”) form an agreement between you and Clancy Learning and its affiliated companies (collectively, Clancy Learning). If you are viewing, accessing, or using any part of this site, you do so under the assumption that you have read, completely understand, and agree with the terms listed herein.
Please note that Clancy Learning's policies are reviewed periodically. Clancy Learning reserves the right to modify these policies at any time without notice. Any changes to the policies will be posted on this site and will become effective and binding after their posting. Your continued use of this website will be deemed conclusive acceptance of such modification. Any comments or questions concerning this policy should be addressed by entering your comments through our Contact Us page.

Privacy and Security

From time to time, Clancy Learning may ask you to provide information about yourself. For example, if you join our online community, we would like to know your name and e-mail address. If you are granted privileges on our site, such as authoring or publishing, we may ask for further information. If you buy something from us, we will collect information such as name, address, and credit card information, such as card number, expiration date, billing address, verification code, and name on the card. We may also collect information about your preferences, such as clothing sizes. All this information is provided voluntarily by the User through various order forms, email messages sent to Clancy Learning, submit forms, identification forms, discussion forums, information provided by the telephone, etc. Clancy Learning also collects different types of non-personally identifiable information about its website visitors. These include but are not limited to referral URL's, Users' IP addresses, Users' use of website, information about the browsers used by the User, etc.
Clancy Learning recognizes the importance of protecting the information collected from Users in the operation of this website, and take reasonable steps to maintain the security, integrity and privacy of any information in accordance with these Policies and Terms of Use. By submitting your information to Clancy Learning you consent to the practices described herein.
Clancy Learning will seek to ensure that any identifiable personal information it collects during the registration and purchasing processes will be adequate, relevant and not excessive for purposes of operating this website or any of the services operated hereunder. Except where necessary in connection with services provided by appropriate intermediaries, who will be required to comply with the confidentiality provisions of this policy, or as expressly provided herein, Clancy Learning will not disclose any personal information identifying Users to any third party, unless required by law or otherwise needed in connection with legal proceedings or unless we have received your consent. Personal information and any other communications or information supplied to Clancy Learning may be used by Clancy Learning for internal business and research purposes and to help enhance and develop our websites.
Clancy Learning uses the collected User's information mainly to provide the service requested by the User. It is used for initial service provision and ongoing User's support. For example: the Credit card information of the User may be provided to the card issuing bank, or other partnering entity involved in the payment processing for payment confirmation and verification. If you provide Clancy Learning with your e-mail or postal address, you may receive periodic mailings from Clancy Learning, containing content, information about new products and services, or upcoming events. Clancy Learning does not make its postal mailing address lists available to other companies except as described above. If you do not wish to receive postal mailings from Clancy Learning, please let us know via email using the Contact Us page. Please provide us with your exact name, e-mail address, and postal address and state which lists you wish to be removed from so that we can be sure your information is removed from those mailing lists. The information can also be used for resolving ownership and other disputes and enforcing agreements between Clancy Learning and the User. Clancy Learning may also disclose the User's personal information if this is required by law, or Clancy Learning believes in good faith that it has to do so to protect the rights and the property of Clancy Learning or its customers. Clancy Learning may also transfer personal information of its Users in connection with a sale of Clancy Learning's business.

Operation of the Clancy Learning website relies on technologies and hosts over which Clancy Learning has little or no control. While Clancy Learning takes reasonable measure to ensure these technologies and hosts are secure, there may be instances where security is breached due to problems with these technologies and hosts for which Clancy Learning cannot and will not take responsibility. By choosing to provide personal information to the Company the user understands and agrees that the security, integrity and privacy of his/her information cannot be 100% guaranteed. For further information on the steps taken by these technologies and hosts to provide security, please research such companies as SiteGround, Joomla, VirtueMart, Authorize.net, MasterCard, Visa and AlphaSSL. You should also understand the security measures provided by you own system, including your computer, your software and your ISP.
You should be aware that identifiable personal information--such as your name or e-mail address--that you voluntarily disclose that are accessible to other Users (e.g. on discussion forums) could be collected and disclosed by others. Clancy Learning cannot take any responsibility for such collection and disclosure. Clancy Learning highly suggests not using the same username or password on our site as the username or password you use for any other purpose. You should also change your password frequently.

Customer Service

Clancy Learning wants you to be satisfied with the products and services we provide. Please understand that we are a small business, and so cannot always provide immediate response to queries and problems. Please e-mail any queries or problems using our Contact Us page, and we will respond as soon as we get an opportunity. Responses will normally be within 1 business day, although may take longer.
We are also not in a position to mitigate or overcome serious risks as a larger company might. Please do not take any risks using our company with which you do not feel comfortable.

Refunds

Due to the nature of our products as deliverers of content, Clancy Learning will not refund purchases. Once the order has been placed, it cannot be changed. Please consider your orders carefully.
(In the event that we do change an order or make a refund, it will be at our sole discretion and will not imply any future changes or refunds.)

Exchanges

If the item arrives to you with a defect that was present before the item was shipped, we will be glad to exchange the item. If you receive an item different than the item you ordered, we will also gladly exchange the item. Exchanges will be made with an exact replacement of the item that was ordered. If Clancy Learning agrees to the exchange under such circumstances, we will pay shipping costs for the return and the shipment of the new item.
Requests for exchange must be reported to us within 14 calendar days of the date we shipped the item or 7 calendar days of the date it was delivered to you (whichever comes first). Exchange items will be shipped when we receive the originally shipped item and verify the reported issue. Items to be exchanged must be shipped to Clancy Learning within 7 calendar days of reporting the issue. All items must be returned to us in the same condition as the condition in which you received it, and in their original packaging.
No exchanges will be made for correct items that are functioning properly and undamaged. No exchanges will be made for items sold in other-than-new conditions, such as items that are sold as refurbished, as is, or blemished. Note that this exchange policy applies only to items created by Clancy Learning. Policies for items created by other vendors depend on the policies of those vendors.

Lost or Damaged Shipments

If we ship an item to you and, through no fault of Clancy Learning, you do not receive it or it is damaged in shipment, Clancy Learning may choose to refund or resend or not to refund or resend based on our own sole discretion. Our resolution will depend in part on the shipment method you chose, the shipper’s delivery policy and the shipper’s delivery status. In general, if the shipper confirms that they have made or attempted to make the delivery to the address you provided, then the responsibility for resolving the issue resides between you and the shipper.

Payments

Payments made by check will not be shipped until the check has cleared. A fee may be charged by Clancy Learning for any returned checks.
Do not send cash by mail.
In special cases where a refund is made (at our sole discretion), we will post the refund to your credit card. Please allow 3 to 6 weeks for the payment to be credited back to you. We will likely need you to supply us with the credit or debit card information to which the order was originally placed.
Note that, even if Clancy Learning does not charge you sales tax on your order, your locality may require you to pay sales tax on your own. If your organization is a non-profit, and is not required to pay sales tax, Clancy Learning will need to receive all required non-profit documentation before payment arrangements are made.

Shipping

We ship most orders within 2 to 5 business days. Larger orders (which may, for example, exceed our current inventory) may ship in up to 15 business days. We are capable of express shipments in many cases, however we will only do so according to arrangements to which we explicitly agree. Please contact us if you require a shipment in fewer days than our standard shipping time. Additional fees may apply.
Of course, after we ship your order, the time it takes for you receive it will depend on the shipping company and shipment method you choose. Your shipment options will be listed in the checkout process. When choosing a shipping company and method, please note that Clancy Learning cannot take responsibility for the shipment (including delivery times and lost and damaged packages) once it has been given to the shipping company. Different shipping companies have different benefits and shortcomings, and the cheapest solution may not always be the best. Please review shipping company documentation and consider these benefits and shortcomings before you make your choice.
If you reside outside of the continental United States, your international shipment may incur additional risks and delays, which might include customs regulations and import/export practices. Clancy Learning cannot stay abreast of the regulations and practices for international shipment. It is your responsibility to understand these regulations and practices and accept all risks for international shipments. You will also be responsible for any taxes, duties, fees, or fines that may incur because of your shipment.
Please ensure that your address is 100% complete and accurate. Clancy Learning will not be responsible for customer inaccuracies in address information and you may receive an extra charge from the shipper. Please note that some shippers, such as FedEx and UPS, do not ship to PO Boxes. If you require shipment to a PO Box, you must use the United States Postal Service (USPS). Clancy Learning does not take responsibility for damage caused through shipping to a PO Box. Please also note that shipments go out according to standard shipping practices for the shipping company; Clancy Learning (and most carriers) does not accept special shipping instructions or signature required orders.

Errors

On occasion, Clancy Learning may place information on our site that was unintentional or in error. For example, an item may be listed at an inaccurate price. In the event that the price listed was too low, we will not honor these prices and will instead provide a refund. If the price listed was too high, we will refund the difference in price between the listed and intended prices.

Everything on this site (including, but not limited to, trade and service marks, content, statements, pictures, graphics, music, sounds, models, stories, wording, video, audio, etc.) is the exclusive property of Clancy Learning and our affiliates.
With the exception of short  excerpts (i.e., one 2 to 4 sentence quote) used for reference purposes, no part of this site may be quoted, displayed publicly, reproduced, stored in a retrieval system, or transcribed in any form or by any means, electronic, mechanical, photocopying, recording, or otherwise, without the prior expressed written permission of the ownership of Clancy Learning.
In all cases, the user assumes complete responsibility to protect the intellectual property rights of Clancy Learning and our affiliates, including but not limited to prosecution. Anything expressed by anyone (including but not limited to: advertisers, links, referrals, recommendations, book reviews, comments on discussion forums, etc.) other than Clancy Learning shall not be held as representative of the views of Clancy Learning, and Clancy Learning shall not be held responsible or liable for such views. Mention, including but not limited to advertisement, citation, or link, does not necessarily mean endorsement.
Anything that you post to the site, including but not limited to discussion groups, must be in the spirit of furthering understanding. Give consideration to what you are posting and the effects it will have on others. Do not post materials with the intent to harm.
Note that you are fully responsible for anything you post.

Legal Action

Clancy Learning reserves the right at our discretion to prosecute or aid in prosecution or to refuse to prosecute or aid in prosecution for any violation of terms or any other misuse (including but not limited to slander, liable, abuse, threats, defamation, race or hate crimes, and accessory to a crime) to the fullest extent of the law. Any decisions not to prosecute do not in any way constitute endorsement or permission to violate the terms. If permission is given to do an action contrary to these terms (for example to use intellectual property), that permission applies only to that action (for example, using the particular piece of property for which permission was given) and does not constitute permission to violate any other part of these terms.
In no way is Clancy Learning or any of our affiliates responsible for any damages beyond the dollar amount the particular customer spent on Clancy Learning products. In the event of legal action, Clancy Learning may, at our sole discretion, choose to settle the action using Alternative Dispute Resolution rather that court. Any exception, breach or waiver of any part of this agreement does not negate that part of the agreement or permit or imply any further exception, breach or waiver.
This agreement shall be governed in all respects by the laws of the state of Texas, USA as such laws are applied to agreements entered into and to be performed entirely within Texas and between Texas residents. This agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof. If any part of this agreement is deemed unenforceable, all other parts of the agreement shall remain enforceable.
